Giffords Path to Recovery

US politician Gabrielle Giffords may be unable to return to work following her traumatic brain injury after being shot in the head at a supermarket in Arizona. She remains in critical condition as she was placed into an induced coma as her body recovers from the event. Giffords surviving a bullet to the brain is an unlikely event as it is an injury that many do not live to tell.

The three-term Democrat is expected to live and has been making tremendous progress.  There have been reports of Giffords’ ability to communicate with her hands which suggests that she may have the ability in the future to communicate verbally. Giffords can breathe on her own, respond to voice commands and even make small spontaneous motions.

Traumatic brain injuries that are caused by bullet wounds include damage directly caused by the bullet to tissue, and indirect damage to neurons caused by the shockwave throughout the whole organ. Although it is known that the bullet hit Giffords’ left hemisphere, the area that controls language, it is unknown exactly how her recovery will go. Traumatic brain injuries are often unpredictable and have long recovery periods.

Many who experience traumatic brain injuries seek compensation for unpredictable recovery costs and time. If you or a loved one is suffering from a TBI call LegalView today to learn more about your options from a brain injury lawyer. Call 1-866-9LAW-NOW (1-866-952-9669).

Asbestos clean up continues in US schools

As the US realizes its error of long asbestos use and attempts to correct the problems now rampant across the country, reminders consistently pop up to clarify the daunting height of such a task. Ridding the nation of just one toxic chemical could take exponentially longer than it took to spread it through homes, buildings and machinery across the country.

Smith Middle School of Chillicothe City Schools in Ohio is one such reminder. The schools facilities were closed in 2007 following the opening of a new school. Administrators are now considering all possibilities for the property’s future. Regardless of whether the school is rebuilt, sold, or razed, however, aged asbestos materials used in its original construction and remodels over the years must be removed.

Asbestos poses no threat if contained inside secure components. As an example among countless other things, many floor and ceiling tiles manufactured and installed in the US have been made with asbestos. As long as the tiles stay intact and undamaged, there is no safety or health risk. However, over time such materials begin to wear out, allowing the asbestos fibers to become airborne. This is particularly so in municipal buildings like schools where high traffic is an almost daily reality.

Smith middle School was built in 1931, well before asbestos health risks were known. It was not until the 1980’s that the US began to regulate use and removal of asbestos. The Environmental Protection Agency now outlines responsibilities regarding asbestos use in its Clean Air Act. Regulations are showing up around the world as asbestos proves its harmfulness again and again. The World Health Organization includes asbestos on its Type 1 carcinogen list along with arsenic.

Asbestos causes several respiratory conditions including asbestosis, lung cancer and the rare cancer mesothelioma. Mesothelioma is most associated with asbestos as its almost exclusive cause. Inhaled asbestos fibers can begin a mutation in lung lining cells that grow into characteristically irregularly patterned malignant tumors of mesothelioma. There are mesothelioma treatments available—surgery, radiation therapy and chemotherapy among them—which directly attack the cancer. Many mesothelioma patients are choosing palliative treatments which focuses on quality of life and pain management, as there is no known cure for mesothelioma and it’s prognosis includes a short life expectancy.

Chillicothe City Schools have received a grant for $200,000, which will offset the total costs of $250,000 to have asbestos safely removed from Smith Middle School. These funds were awarded form the Ohio Department of Development as part of the Brownfield Revolving Loan Fund.

Nursing Home Closures due to Lack of Funding

Across the nation nursing homes are closing due to underfunding. The nursing homes are primarily closing in minority and poor areas because of underfunding by Medicaid. The average nursing home worker earns close to minimum wage, much less than other health care workers, which makes it difficult to hire good help. Medicaid covers close to 2/3 of nursing facilities funding, the rest comes from individuals either private-pay or insurance. Medicare will pays for a short-term rehabilitation, but does not reimburse for long-term care in a nursing home.

The states with the highest cuts are New York, Illinois, Massachusetts, New Jersey, California, Pennsylvania and Ohio. Minority communities, mainly Black and Hispanic, are having the most trouble keeping their nursing homes open. The best solution would be to improve access to home-based care and other community-based care models, such as assisted living facilities.

With nursing homes closing, the elderly are having trouble finding places to live. Between 1998 and 2008, there has been a 5% decrease in the number of  beds available.

Think you have been neglected by a nursing home? Contact LegalView today regarding your legal options regarding nursing homes today. Call 1-866-9LAW-NOW (1-866-952-9669) for a lawyer that can advise you on your legal options and help you pursue justice.

Mesothelioma threat through national fiber-optic initiative

Asbestos has put another stop to Australian advances. The National Broadband Network (NBN), a government owned company, has had to halt their progress towards a nationwide fiber installation due to the presence of asbestos.  With a massive plan to include 93% of the nation, NBN set about connecting the country through fiber-optic technology. Only 7% would be left with other forms of internet and digital connectivity.

The plan included use of existing telegraph poles and underground conduits. About 25% of the new fiber would be hung from poles while the large majority would be buried in an existing underground infrastructure of ditches. However, asbestos was found to be present in the cement and building materials of included ditches and conduits.

Switching its primary focus from technology to safety, NBN administrators are now considering the best way to move forward. Exposing asbestos would threaten safety and health for workers and the public. Asbestos is known to cause severe respiratory conditions. Rare cancer mesothelioma is most associated with asbestos exposure. Mesothelioma is characterized by malignant tumors in the lung ling and lining of other abdominal cavities. There are available mesothelioma treatments, but no known cure.

Costs associates with asbestos removal are high. Trained professionals with appropriate protective gear must test all potentially dangerous materials and them remove it without exposing the fibers. In this case, complexity had been added by trouble differentiating between asbestos and non-asbestos cement.

NBN spokeswoman Rhonda Griffin sounds optimistic. She said the “…costs of asbestos management has been factored in to our business case. Where asbestos is identified or suspected, NBN Co contracts the services of fully qualified asbestos experts to remove any aged asbestos-containing infrastructure and dispose of it as per all safeguards required under regulation. Independent hygienists are engaged to monitor any removal.”

Asbestos removal contractors are anticipating a busy season as this unexpected NBN situation redirects funds and efforts. Director of Sydney based asbestos removal company Alkene, Bill Snell said, “It’s going to be a major job actually.” He expects his firm and others to be busy.

There is a responsibility to the public in this case, which causes concern for many. A nationwide effort to connect a population may easily turn into a nationwide nightmare. With health and safety on the line, not all are so confident of NBN’s, and the government’s, ability to handle it.

Communications Electrical and Plumbing Union national secretary Peter Tighe said, “It’s obviously something we’ve got to be very careful about. You can’t just send somebody out and say, ‘Pull cables through’.”

Mesothelioma Applied Research Foundation to Hold Symposium

From June 23 to 25, 2011, the Mesothelioma Applied Research Foundation will hold an annual international symposium on malignant mesothelioma. The Mesothelioma Applied Research Foundation is a non-profit organization, which provides funds research and services to patients that have mesothelioma.  The three-day conference will allow participants to express their concerns regarding mesothelioma research and  the ban of the use of asbestos.

The symposium will also educate attendees about the effects of asbestos to health and the existence of mesothelioma, as well as the threat it brings to public and economy. Experts from across the world will share their stories with people in the same situation. Participants can register for the conference via the organization’s website. The website will also contain the agenda for the conference starting in March.

Mesothelioma, is a rare and aggressive form of cancer that claims nearly 3,000 lives in the United States alone.  Mesothelioma is caused by the inhalation of asbestos, a fire retardant and insulator that was used widely until the 1970's.  However, there are no early symptoms and it can take over 30 years to diagnose mesothelioma. Most victims do not realize they have the disease until it is too late. Due to this lag in diagnosis time, workers in the construction, mining, industrial and even family members of those who work in these fields are still dying from the asbestos-caused disease. Household products, including children’s toys can also contain traces of the dangerous carcinogen.

Mesothelioma Utah

mesothelioma utah

Asbestos disposal refers to the process of getting rid of asbestos or other asbestos containing items in a safe way. Asbestos is natural fibrous mineral. Many corporations used it for building and insulation materials. Asbestos was also used widely in fireproofing, pipe covering, cement, refractory materials, gaskets, floor tiles and joint compounds between 1890 and 1970. Exposure to asbestos particles is the reason behind many diseases including life-threatening cancer called mesothelioma. Looking at the harmful effects of asbestos exposure, no one can underestimate the importance of safe removal and disposal of asbestos.

It is better to dispose off some asbestos containing appliances such as oven rather than trying to separate the asbestos from it for disposal because separation of asbestos may prove to be very expensive and it can be hazardous. In some cases instead of complete removal of asbestos, we can seal the exposed insulation. Sealing minimizes the further risk of formation of airborne particles. Experts believe that Inhalation of asbestos fibers is much more likely when the asbestos is fragmented and airborne. Therefore, only a specialist should handle the process of asbestos disposal.

If you are planning the asbestos disposal process, then you should read the detailed instructions called Asbestos Removal Procedures for Home Owners of Utah State Department of Environmental Quality. Following are some recommendations to make asbestos disposal safe.

1. You must wet the friable asbestos containing material and place it in properly labeled leak-tight containers before shipping.

2. Only certified asbestos personnel must handle the regulated asbestos containing material.

3. You should not carry on the process of asbestos disposal during the periods of high wind.

4. Entry of unauthorized personnel must be strictly prohibited during the asbestos disposal process.

5. Friable asbestos and Category II non- friable asbestos-containing material should be covered by the end of each operating day with at least six inches of non- asbestos containing material such as soil. Category 1 non- friable asbestos containing material may be spread prior to being covered, but shall be covered by the end of each operating day with at least six inches of compacted non-asbestos containing material such as soil

6. You must maintain the records and file them to notify future landowners or interested parties, the locations and quantities of the asbestos waste buried at the site. A notice on the deed to the property must state that the site is subject to regulation and should include precautions against any attempt to disturb that area.

Expert Blog – Part 2 on Unsafe Drugs

Part 2 in a series of guest blogs about pharmaceutical litigation and medical devices

from James McHugh Jr., Esq.
Lopez McHugh LLP, Attorneys and Counselors at Law

In 2006, Glaxo recalled Paxil, an antidepressant, because some of the pills lacked an active ingredient—meaning the pills were useless.  Problem is, Glaxo did not bother to warn patients who might have been taking them, even though abruptly stopping the drug can lead to thoughts of suicide; many patients were successful.  And this was even after the FDA seized some lots of Paxil in 2005 for the very same reason.[1] But hey, they managed to sell $11.7 billion worth of the drug in the U.S. alone, so they still turned a profit.[2]

In July 2010, the FDA held hearings concerning the diabetes drug Avandia. The FDA accused Glaxo of repeatedly submitting sloppy data and failing to follow up on reports of problems among patients, including stroke and premature death.  Glaxo had ignored (or covered up) this information even though the drug had been on the market since 1999.[3]

Today’s corporate bigwigs have no reason to care what happens to the end users of their products, because they rarely face civil or criminal penalties.  Obviously, it is more difficult to impose criminal liability on a large corporation when the decision making process is divided among a number of individuals.

CEOs don’t even have to worry about angering their own shareholders.  So what if the company will wind up having to pay millions of dollars years from now?  The president of Evil Drugs, Inc. isn’t planning on sticking around that long.  He’ll make his millions, then at the first opportunity jump ship to another corporation.  Corporate America just keeps putting the same people in charge.  That’s why, after the recent government bailouts of the banks, the same people who put us in the mess in the first place wound up keeping their jobs.  Evil protects itself.

Federal and state attorneys general should consider more criminal litigation; the FDA has recently indicated a desire to prosecute corporate executives at drug companies that repeatedly violate good manufacturing practices.[4] In the meantime, as there is no real potential for criminal punishment, our civil system is really the last line of defense against corporate America.

We do our part to bring some form of justice to the system, but let’s face it: the best we can do is provide for our clients’ needs, provide for their families, and hope that one day big pharma will finally stop putting profit motive before patient safety.

Asbestos illegally dumped in Toledo

The city of Toledo, Ohio is searching for the culprits of illegal asbestos dumping. Over the last two months three separate deposits of bagged asbestos material have been found throughout the city. Materials in the bags seem to be related, although there is no certainty as of yet that they came from the same source.

The World Health Organization classifies asbestos as a Type 1 carcinogen. Causing severe respiratory conditions including lung cancer, asbestosis and rare cancer mesothelioma, asbestos is a serious public health hazard. Used for decades in industries throughout America, and across the world, asbestos is present in countless building and structural materials.

Considered non-threatening when contained in other materials, asbestos fibers become a risk when airborne. In residential construction asbestos is commonly associated with floor and ceiling tiles. If intact, risks of asbestos exposure from such items are low. However, after much wear and tear, or in the event of demolition, asbestos fibers can become exposed, airborne and dangerous.

If inhaled asbestos fibers can begin a mutation in lung lining and lining of other abdominal cavities. This mutation grows into mesothelioma, a fatal cancer. Mesothelioma is characterized by a long latency period, between twenty and fifty years. Without knowledge of asbestos exposure, patients have no idea they could be developing mesothelioma. Following diagnosis patents average an eighteen-month life expectancy. There are mesothelioma treatments available, but no cure. Treatments include palliative care, which focuses on pain management and enhancing quality of life, as well as surgery, chemotherapy and radiation therapy.

City of Toledo authorities found over 100 cubic feet of asbestos material dumped at two locations. A total of sixty bags were found in an alley on St. Lois Street in East Toledo and in an empty house in North Toledo. Just in the last two weeks another 29 bags were found on Champlain Street.

The Environmental Protection Agency (EPA) takes asbestos exposure seriously as a health risk. In its Clean Air Act, the EPA describes guidelines for maintaining and promoting air quality, which includes proper use and removal of asbestos. In accordance with these regulations, Ohio contractors are required to have certifications and special licensure to remove asbestos. An Ohio EPA air pollution control permit is also required for proper disposal of asbestos materials in approved landfills. High costs can be associated with such work; cut corners and fraudulent reporting have become a more regular occurrence nationwide.

Mesothelioma and Women

While most victims of mesothelioma are men, women are not immune from contracting this deadly cancer. There is no demonstrated biologic reason why women who inhale asbestos would have different biological responses to harmful asbestos fibers than men. There is no data to show that female physiological mechanisms are any more protective against asbestos disease than those of their male counterparts.

Studies report that a little more than 20% of cases of mesothelioma occur in women. There is also some indication that there is a rising incidence of mesothelioma in women in the United States, Australia and the United Kingdom in recent years.

Mesothelioma is a disease that is strongly associated with asbestos exposure. The latency between exposure to asbestos and the diagnosis of mesothelioma can be many decades –twenty, thirty–even fifty years. It is not uncommon for women who contract mesothelioma to report to their physicians that they are unaware of how they were exposed to asbestos.

Many women did not work in occupations where they directly handled or were around asbestos. Studies show that only about one-fifth of women with mesothelioma had a history of occupational exposure to asbestos. For the majority of women with mesothelioma, their non-occupational exposure experience becomes much more significant. Studies show that for the majority of asbestos exposed woman with mesothelioma, most women were exposed to asbestos when living in a household where someone else worked with asbestos or by laundering asbestos-soiled clothing. These are called domestic or household exposures.

Recognizing the strong association of prior asbestos exposure to mesothelioma in women is something that is still lagging in some parts of the medical and scientific community. One reason is that the data that has been collected pertaining to the incidence of mesothelioma has been narrowly focused on looking at a person’s occupation. The statistical reporting often neglects to ascertain information about domestic or household exposures.

Since more women’s exposure to asbestos consists of domestic or household exposures, as opposed to occupational exposures, the female exposure experience is often under-reported. This “gender bias” in the medical and scientific literature makes it easier for asbestos companies to try to deny responsibility for causing mesothelioma in many women.

If you are a woman diagnosed with mesothelioma, the importance of finding a mesothelioma law firm that specializes in asbestos lawsuits will be even more important in order to achieve a successful and timely settlement or verdict.

The attorneys at Clapper Patti Schweizer & Mason are experts in this field, having practiced on mesothelioma law for close to thirty years, and have won millions of dollars for their clients.  Because of specializing in handling only asbestos cases, the attorneys are experts at determining where, when and how the exposure occurred and who was responsible.  For a free consultation, visit www.mesothelioma-attorney.com.

Auto Mechanics at Risk for Mesothelioma

Adding to the list of all the other industrial jobs that have a risk to exposure to asbestos, automotive mechanic is yet another occupation in which workers are unaware of the prevalence of asbestos-containing products in automobile parts. Mechanics are advised to take precaution and keep themselves informed with asbestos exposure and the risks associated with the toxin.

It is estimated that two-thirds of automotive garages have asbestos dust present at dangerous levels. Automotive mechanics are at a high risk of inhaling loose asbestos dust while working on cars. Not only are professional mechanics at risk, car enthusiasts who perform maintenance on their own cars are equally at risk to inhaling the asbestos fibers.

The asbestos fibers could potentially enter the home of both mechanics and car enthusiasts if the dust is left on their clothes, not an unheard way of creating risk for family members.

Because of mesothelioma’s long latency period the incidence in mechanics is expected to peak in the next couple of years. Today asbestos-containing automotive parts continue to be used.

Mechanics exposed to asbestos are advised to learn their options regarding mesothelioma treatments and compensation. Contact Legal View anytime to learn how you and loved ones can protect yourselves. Epithelioid Mesothelioma Cancer: Prognosis, Symptoms & Treatments

Epithelioid mesothelioma is said to be the most common form of mesothelioma. This type of cancer is responsible for over half of all diagnosed cases. Epithelioid mesothelioma develops in the mesothelium that surrounds certain organs. Epithelium provides many important functions such as filtration, secretion, protection, and absorption.

Prognosis for patients with epithelioid mesothelioma is very bleak. The average survival time after diagnosis is approximately six months.

Symptoms can occur after 20 to 40 years of being exposed to asbestos. It is very difficult to diagnose because doctors may not consider mesothelioma as the illness due to the similarities in symptoms from common illnesses, like pneumonia or bronchitis. Symptoms include:

Severe chest painFatigue and weaknessWeight lossLoss of appetitePersistent dry cough

Treatments vary depending on the stage of the cancer in addition to the overall health and age of the patient. There are also differences in the way each type of cancer responds to treatment. Aggressive treatment is sometimes appropriate depending on the stage of the cancer. In general, patients diagnosed with malignant epithelioid mesothelioma have a better prognosis than patients with sarcomatoid mesothelioma.

If you or a loved one has had a diagnosis of epithelioid mesothelioma, it may be in your best interest to get a second opinion from an oncology specialist so that an accurate diagnosis can be confirmed. Appropriate treatment is based on the accuracy of the diagnosis.

Also, if you or a loved one has received a diagnosis of epithelioid mesothelioma, you should enlist the service of an experienced mesothelioma attorney or law firm. In most cases, asbestos exposure victims are entitled to receive compensation for their many losses, which may include:

Medical costsLoss of employabilityLoss of incomeEmotional sufferingPain and sufferingAnd future losses due to mesothelioma

Federal Court Protects Alimta Against Generic Competitor

Eli Lilly & Co. has won its case in Federal court in Delaware where it sought to protect its patent for the drug Alimta.  Alimta (pemetrexed for injection) now marketed by Eli Lilly & Co. (“Lilly”) was developed in clinical trials by Lilly in the early 1990s after it was discovered that disodium pemetrexed, the active ingredient of Alimta, was very effective when dosed in a concentrated liquid for treating mesothelioma and other forms of lung cancer.

Since its approval by the FDA in 2004, Alimta has been used in conjunction with another chemotherapy drug, Cisplatin, to treat patients with malignant pleural mesothelioma.  Malignant pleural mesothelioma (“MPM”) is a form of cancer that forms in the lining of the lung and is caused by exposure to asbestos fibers.  Symptoms of mesothelioma typically do not begin to develop until decades after exposure, and after the cancer has reached advanced stages.

Treatment options for any late stage cancer but particularly mesothelioma are limited and cannot be curative so therefore focus on palliative relief and improving quality of life.   Standard therapies for mesothelioma include surgery (when possible,) chemotherapy and radiation therapy.  Alimta is one of the most commonly used drugs in chemotherapy to treat mesothelioma.

The combination of Alimta and Cisplatin has been used to slow or shrink MPM in patients and has provided a treatment option in many cases where surgery was not an option due to the patient’s health or age.   Clinical trials offered through the National Cancer Institute (NCI) are constantly searching for new combination therapies or drugs that might help lengthen survival times and improve quality of life.

The Federal court found that Eli Lilly & Co.’s patent would be infringed upon if Teva Pharmaceuticals Industries, Ltd. was allowed to market a generic version of Alimta in the United States.  Eli Lilly & Co. claimed their patent does not expire until 2016.

Asbestos Dumped Illegally in Ohio

The Ohio Environmental Protection Agency (OEPA) announced that would press criminal charges in an increased effort to find those who had illegally dumped 60 bags of asbestos waste in two areas in Toledo, Ohio. The dump was done sometime between October 30 and November 5. The Ohio EPA is asking any individual who has knowledge of the dumping to contact them. If identified, criminal charges could be filed – particularly if it can be proved that the dumping was both deliberate and negligent.

Investigators found 60 bags and a total of about 100 cubic feet of asbestos whose origin remains unknown. They assume that both the dumps were done by the same person and suggest that the waste likely came from a large building rather than a single-family home.

Mesothelioma, which is almost exclusively caused by asbestos, is one of the most deadly and aggressive forms of cancer and claims nearly 3,000 lives in the United States alone. These 3,000 lives were most likely exposed to asbestos used in the 1970's as a fire retardant and as insulation used in many buildings. Mesothelioma is caused by the inhalation of this mineral, but there are no early symptoms and it can take over 30 years to diagnose. Most victims do not realize they have the disease until it is too late.

A third dump site, which was just found contains an additional 28 bags of asbestos with materials that are similar to what had been found earlier at the other two locations.  The third site was located after an anonymous phone call was placed.

Can Asbestos Exposure in Schools Lead to Mesothelioma?

Many Americans know that exposure to asbestos causes mesothelioma cancer. Asbestos is a substance that was commonly used in building materials in the last century. This is why when this lung cancer is mentioned, those that worked in the construction and production industries are thought of as the victims. This being the case: Can asbestos exposure in schools lead to Mesothelioma cancer?

Medical professional have documented that many of victims of Mesothelioma cancer are students and teachers that were exposed to asbestos on their campuses. Students and teachers did not know about the present of the substance and its deadly affects. The companies knew of the harmful effects of these materials however, they preferred the use them over other less harmful materials. Administrator did not mind the use of asbestos because of the cost of the materials and it fireproof qualities. It just made good sense.

American campuses had many types of asbestos products and student, teachers, and staff was not aware that even short-term exposure to asbestos could mean dealing with Mesothelioma cancer in the future. They were not only exposed during construction but also during repair and even during removal of the hazardous substance.

Teachers and students also unwittingly exposed others like parents, siblings and spouses. Even limited exposure to the substance increased the chance of a person developing mesothelioma in later years sometimes 30 to 40 years after exposure. The percentage of probability increases with the length of asbestos exposure.

When people inhale asbestos fibers into their lungs it clings to the thin lining of the lungs called the mesothelium. Then tumors develop around the fibers and sometimes in other parts of the body. When these tumors grow large enough, they cause the Mesothelioma cancer victim pain, discomfort and other symptoms.

The majority of the time Mesothelioma cancer is not found until the infection is too significant to be treated. Often treatment of mesothelioma is just for the comfort of the victim. These patients rarely survive more than a year or two. To date there is no effective treatment for this deadly form of cancer.

So, asbestos exposure on school and campuses can lead to Mesothelioma cancer in the future. Because of this, it is important for those who believe they have been exposed to asbestos on the countries campuses to be screened regularly even if they are not displaying symptoms. It is also vital that they contact an experienced Mesothelioma lawyer to see if they are due any compensation. Screening and treatment of this cancer is very costly.

New Health Care Benefits for 2011

The Patient Protection and Affordable Care Act (PPACA), better known as “health care reform” and derided by some as “Obamacare,” passed into law with great fanfare last March. If you haven’t noticed any change in the health care system, that’s partly because most of the law’s provisions have yet to go into effect.

Many of the most important changes won’t happen until 2014, including the requirement that insurers cannot refuse to insure someone with pre-existing conditions. Let’s face it — by the time we reach 50, nearly all of us have “pre-existing conditions.” Our chances of being “pre-conditioned” go up as we age –  mesothelioma, for example, is rarely diagnosed in patients younger than 50.

So we’ll have to wait a little longer for that benefit. A few of the law’s other provisions will kick in on January 1, however. Here are some changes that will affect people insured by a private insurance company or by Medicare:

PPACA puts a limit on the “minimum medical loss ratio,” which is a fancy name for the difference between what the insurer receives in premiums and what is paid out in benefits. Now, large group plans must spend at least 85% of premium income on benefits, and for small group and individual policies at least 80% of premium income must be paid out in benefits.

This ratio must be reported to the government, beginning January 1, and if an insurer doesn’t meet the ratio requirement, the insurer must give its customers a rebate.

Beginning January 1, the government is required to create a Community Living Assistance Services and Supports program. This will be a voluntary insurance program to provide benefits to pay for assisted living and long-term care when someone becomes disabled. Details of how the program will work and how people can sign up should be released later this year.

Several changes will affect Medicare — beginning January 1, pharmaceutical companies must provide a 50% discount on brand-name prescriptions filled in the Medicare Part D coverage gap. Subsidies for generic prescriptions filled in the “gap” will be phased in beginning this year.

For those of you unfamiliar with the gap, also called the “doughnut hole” — previously, Part D benefits helped pay for annual prescription drug costs up to $2,700, but nothing above that. A catastrophic coverage program pays for nearly all yearly prescription drug bills over $6,154. But the costs in between  $2,700 and $6,154 must be paid entirely by the Medicare recipient, which is a terrible burden. This year’s changes will bring some relief. The PPACA will close the gap entirely by 2020.

Beginning this year, doctors will get a 10 percent bonus payment for providing primary care services. Medicare also will give a 10 percent bonus to general surgeons working in areas with a shortage of doctors.

Some Medicare co-pays are eliminated, including co-pays for some preventive services and for colorectal cancer screening. Medicare also will pay for patients to receive a personalized disease prevention plan.

Asbestos miners in India demand results of recent study

On January 4, in Ahmedabad, India, thirty members of Rajasthan State Mine Labour Union protested at the National Institute of Occupational Health (NIOH). Protesters demanded release of a report covering the findings of a study conducted on asbestos miners. The study included one hundred sixty four mineworkers and the possible affects of asbestos mining on their health.

Asbestos is classified as a Type 1 carcinogen. It causes several fatal respiratory conditions including lung cancer, asbestosis and mesothelioma. Asbestos use has become highly regulated in many developed countries, as the safety and health hazards have become known. However, in developing nations, such as India, asbestos continues to be used regularly and without proper protective measures.

The US covers asbestos use in the Clean Air Act, the Environmental Protection Agency’s code of conduct regarding the quality and maintenance of American air. Currently, asbestos lawsuits are piling up in America, the UK and Australia as individuals and companies violate public health regulations. However, throughout the world thousands are working with and around asbestos without the benefit of such regulations or even the safety education to take personal precautions.

Asbestos is considered to be the exclusive cause of rare cancer mesothelioma, a cancer affecting abdominal cavity lining, most commonly of the lungs. Airborne asbestos fibers can begin a mutative process if inhaled. Mesothelioma takes decades to develop—typically between twenty and fifty years to show symptoms. Diagnosis is difficult as most mesothelioma patients have no idea they were exposed to asbestos, and therefore do not know what to look for. Coughing and wheezing are normal symptoms of mesothelioma, but often misdiagnosed as pneumonia or other respiratory infections.

In India and the developing world, testing and treatment centers for such a specialized disease are hard to find. Mesothelioma patients in India are hard-pressed from their beginning of unprotected asbestos exposure, through the end with limited adequate testing and mesothelioma treatment facilities.

Rana Sengupta, managing trustee of Mines Labour Protection Campaign (MLPC), reported that of the one hundred sixty four workers in the study, nineteen have already died. Results from the study would greatly help mining and union authorities to implement proper protective measures and to begin treatment for the miners already affected.

An NIOH scientist stated that of those tested 93 workers already showed signs of asbestos related illness. That’s about 65% of the workers still alive who were part of the study. The report however, has still not been released. Many believe there is more to this situation, as members of the NIOH who conducted the testing have suddenly resigned.

Protesters continue to make their demands and are threatening a hunger strike.

About Those Death Panels …

One of the most persistent, and outrageous, rumors about last year’s health care reform law was that the law would establish “death panels” to decide which patients were worthy of receiving medical care. Nothing even remotely like that was ever in the law, but millions of Americans were convinced otherwise.

As a result of the hysteria, a perfectly benign, and sensible, provision was taken out of the Affordable Care Act before it was passed last spring. An earlier version of the bill would have allowed Medicare to reimburse physicians for providing what’s called “end of life” counseling, which only means providing information to people with terminal illnesses so that they can make their own decisions about medical care. This includes informing patients about choosing a hospice  or designating someone close to the patient to be a proxy in case the patient goes into a coma.

It is a sad fact that medical science can’t fix everything. There are some diseases that are nearly always terminal, such as mesothelioma. Sometimes patients and their families struggle to make hard medical decisions, especially when aggressive and painful procedures no longer appear to be helping. If physicians take the time to talk to patients and families about what medicine can and cannot do, and what to expect as the illness progresses, it can relieve a great deal of stress.

The important point here is that decisions about medical care ultimately would rest with the patient and the patient’s family. The point of the provision was only to encourage physicians to take the time to give patients information they need to make informed decisions.

However, you will remember, a number of politicians got hold of this provision and began screeching about death panels, implying that the bill would establish committees to make end-of-life decisions for patients. This was never, ever, in any way, in the health reform bill.

So the end-of-life provision was taken out of the bill to placate the screechers and help get the law passed. But recently right-wing news outlets learned that a similar provision had been added to Medicare regulations, and the screeching began anew.

The fact is, for years private insurance companies have had their own “death panels.” They meet in secret and decided which procedures they wanted to pay for, and which would take too much out of corporate profits. The annals of American medicine are stuffed to the hilt with stories of people who were denied life-saving care because their insurance carriers refused to pay for it.

There are other “death panels” you might not know about. The states of Virginia and Texas have passed what are called “futile care” laws. These allow a medical facility to refuse to give life-sustaining treatments to a patient if a panel of doctors decide the care is futile. Under these laws, facilities can halt kidney dialysis treatments or refuse to give patients respiratory assistance even when the patient is conscious and wants to keep fighting his disease.

As a practical matter few facilities would refuse to extend treatment — as long as it is being paid for. Patients with no insurance, or whose insurance refuses to pay, are left vulnerable to the decisions of the real “death panels.”

Cells are the shops blocks that form our lives. We know the cells obviously grow, gulf, and multiply to keep out bodies healthy and stalwart. Occasionally, however, these same cells will allot and multiply when there is no necessity to do so. This fallout in a mass of cells known as a lump, or pest. An abandoned and hasty evolution of cells in the lung is lung melanoma. There are two forms of lung plague: non-small section lung canker and small chamber lung scourge.

The categories of lung menace are based morphology of the cells as seen under a microscope. The two types of lung canker have their trouble methods, as the allotment in different habits.

The most normal form of lung growth is non-small cubicle lung scourge, the style that slowly grows and spreads. In this hall are large booth carcinoma, adenocarcinoma, and squamous cubicle carcinoma, the three foremost types of non-small cabal lung scourge.

Instances of small cabal lung bane are not so regular as that of non-small lung blight. This sort of lung melanoma spreads briskly and may move different organs of the body. This lettering of lung pest is also known as oat cabal evil.

Recently lung bane has been recognized as the deadliest form of disease in many developed nations, including the USA where 170,000 people die from the disease each year. Even though lung changes start almost immediately leading exposure to carcinogens, lung disease takes time together to happen.

The inhalation of the carcinogens through cigarette smoke is the foremost instigate of lung plague in both smokers and non-smokers. The gamble of contracting lung disease increases when there is an environmental exposure to radon compounded with smoking. People working in seats with exposure to asbestos face another form of lung menace known as mesothelioma lung growth.

Most people unnatural by lung melanoma are over the age of fifty and are long-word smokers. Symptoms can diverge depending on the setting of the swelling within the lungs. Some common symptoms compose habitual cough, chest menace, panting, and chronic lung infections.

An experienced fitness cared professional can spot lung growth based on symptoms, smoking chronicle, health narration, previous family memoirs of lung disease, and exposure to occupational and environmental materials. After the first tests, a X-Ray can be worn to make an affirmative diagnosis. Different tests are offered to diagnose small group or non-small lung canker and to gauge the scaffold of the bane. Medical professionals are also able to prove whether the sarcoma is localized within the lung or has applied to other parts of the body.

Three methods treated lung melanoma: chemotherapy (in which tumor cells can be eliminated by medication), radiation therapy (eradicating the sarcoma cells with high-dose x-heat or other high-energy heat) and surgery (ejection of the cancerous cancer). It's considered complex to delicacy vanguard theater lung cancer, but early stand cancer can be treated with moderate success.

As the adage goes, a scrap of prevention means a batter of alleviate. If you smoke, shelter yourself from lung cancer by butting out for good. If you renounce smoking now, you can regularly diminish your threat of cancer over the next 10 to 15 existence as your lungs claim.

Calorie-Balanced Diet May Prevent Cancer

Mounting research suggests that adhering to an energy-balanced diet (consuming only as many calories as you burn) may reduce your risk for cancer. Additionally, the American Institute for Cancer Research (AICR) identifies 12 common cancers that may be spurred by unhealthy diet, insufficient physical activity and improper weight management. These 12 cancers are:

EndometrialEsophagealOralStomachColonPancreaticBreastLungKidneyGallbladderLiverProstate

The most recent evidence that links diet to cancer involves observational studies that asked individuals between the ages of 30 and 60 to answer an in-depth questionnaire regarding weight, diet, physical activity level and other health factors. The participants were then followed for several decades to monitor the development of cancer.

Alarmingly, the AICR reports that as much as 69 percent of esophageal cancers, 45 percent of colon cancers and 38 percent of breast cancers may be directly related to poor diet and improper weight management. Statistically significant percentages were also found for the nine other cancer types.

Previous studies have already suggested that an energy-balanced diet improves cancer treatment outcomes and lowers the risk for cancer to return. However, this is the first study to indicate that healthy diet and lifestyle may actually help prevent the onset of cancer.

Based on these findings, the AICR recommends a variety of health-conscious eating habits. Some eating habits that may decrease risk of cancer include:

Lowering intake of red meat and processed meat (these foods are associated with colo-rectal cancer)Increasing intake of fruits and non-starchy vegetables (may reduce risk of esophageal cancer)Consuming no more than one alcoholic beverage each day for women or two alcoholic beverages for men (alcohol increases caloric intake and may increase risk of breast cancer)Take steps to reduce excess body fat, particularly around the waist (linked to lowered risk of liver, gallbladder and endometrial cancer)Exercise daily for at least 30 minutes (wide-ranging health benefits)

Mesothelioma Symptoms Doctor

mesothelioma symptoms doctor

The mesothelioma symptoms that most people experience can be very detrimental. These symptoms are somewhat different for each person, but there are commonalities that exist. In other words, not every person may have exactly the same symptoms as another person, but both of their symptoms will overlap to some degree, and they will have some symptoms in common.

The most common of the mesothelioma symptoms include chest pain, trouble breathing, and feeling tired more often than average. These symptoms, however, are attached to many other conditions including heart problems, lung problems, depression, and anxiety. Because these symptoms are so similar to other symptoms from other diseases, mesothelioma is not always suspected by a doctor when someone presents with these problems.

Usually, when a person goes to their doctor and is complaining of mesothelioma symptoms, that person is tested for heart related issues. The doctor will look for heart failure, blocked arteries, and other types of issues. Generally, he or she will not look for mesothelioma unless the other tests come back negative and the patient specifically says that he or she was exposed to asbestos.

There is no other common cause of mesothelioma, and when symptoms show up it is important for a doctor to look at all of the possibilities so that a person with mesothelioma symptoms can be diagnosed and treated properly. Sometimes symptoms are not treated right because the doctor does not realize that they come from the disease. This can severely delay treatment for people who need help and therefore these individuals often do not live as long as they could have otherwise.

In addition, the mesothelioma symptoms that a person deals with cause them problems with everyday living. They are often short of breath, and the pain that they are in can keep them from the activities that they enjoyed before their symptoms began. There are treatments available, though, with surgery, radiation, and chemotherapy being popular options.

These can prolong the life of people with mesothelioma symptoms, and they can be a comfort to families and friends who do not want to lose the people that they care about. However, they do not work for everyone. When the symptoms are very advanced, it can mean that the disease has progressed far enough that the treatments normally used to save lives may not work. This is largely why it is necessary to move forward with the diagnosis and treatment of mesothelioma symptoms when they first appear.

Important Conversations if Diagnosed with Mesothelioma

Receiving a diagnosis of mesothelioma is devastating.  Mesothelioma, caused by prior exposure to asbestos, is an incurable cancer that begins in the lining of the lungs, heart or abdomen.  From the time of diagnosis, the patient most often has less than a year to live.  Although there is much research being conducted in the way of clinical trials, to date no cure for mesothelioma has been discovered.
As difficult as it may be at this time, there are certain important conversations to have soon after being diagnosed.  One is about end of life care and the other is filing an asbestos lawsuit quickly so as to get financial help.  These conversations will help the one diagnosed with mesothelioma as well as loved ones and family members to have more choice and control as the cancer develops.
As much as no one wants to think about dying or losing a loved one, talking about ones preferences when it comes to serious illness and care at the end of life, discussions around these issues are important to have before it gets too late for wishes to be expressed.  Without such conversations, people can end up at the mercy of the health care system making such choices for them, sometimes against their wishes.
The conversation might begin with asking the one diagnosed how they would like to be cared for in different situations:  in the hospital, after surgery or treatment, at home, at the end of life, upon death, and after they have passed.  Asking questions about life support, the degree of medication and intervention wanted in pain management, and whether to resuscitate or not will help to ensure that the patient’s wishes are known.  Knowing preferences helps to make sure the one diagnosed gets what they want in terms of care and treatment.
Many loved ones think that the doctor or someone else will bring up the subject, but many will not so it is important to be proactive if you want your wishes known and followed.  Before talking with the doctor, make sure that the family has had conversations that clarify the patient’s desires around care, and then everyone will be prepared when meeting with the oncologist or treating physician.
If you or a loved one is diagnosed with mesothelioma, and want to have more choice about end of life care, a very helpful guide called Five Wishes is used by Hospice and provided through Aging with Dignity.  This guide to end of life care and dying is useful for anyone to do, and one option is for everyone in the family, even if not ill, to fill one out in case they should ever find themselves in an unanticipated medical situation.  A hospice nurse or clergyman might also be helpful and provide support for such discussions.
Another topic many don’t want to bring up when a loved one is diagnosed with mesothelioma is filing a mesothelioma lawsuit and getting financial help to cover medical costs, alternative treatment costs, and any other monetary loss.  However, it is important to bring this up early on as all states in the United States have time limits within which one can file an asbestos related lawsuit, referred to as statute of limitations.  And since most patients will not survive more than a year, it is important to get this process started as soon as possible to have the best chance of either winning a verdict or settlement.
The attorneys at Clapper Patti Schweizer & Mason have been helping clients diagnosed with mesothelioma for almost thirty years.  Mesothelioma lawsuits are their specialty and asbestos law is all they practice, therefore they are leading experts in the field.  Not only that, because of their long history, everyone who works at Clapper Patti Schweizer & Mason, from the secretaries to attorneys, have experienced first-hand the hardship and heartbreak of this painful disease.  Not only do they win their cases, they are kind and understanding from your first call to after settlement or verdict.  This is important when you are already dealing with everything that come with a diagnosis- learning about the cancer,  finding the right treatments and doctors, and making other important life decisions.  For a free consultation, please call 1-800-440-4262.

Drug Improves Long-Term Heart Health for Child Cancer Patients

Child cancer patients who have been treated with the chemotherapy drug anthracycline are three times more likely to suffer from cardiac death 30 years after treatment than children not treated with the drug. Now, a complementary drug given during the time of chemotherapy has been shown to significantly improve long-term heart health, according to researchers of the Dana-Farber Cancer Institute Childhood ALL Consortium.

Anthracycline is a common class of cancer drug that is used to treat everything from leukemias and lymphomas to breast cancer, ovarian cancer and lung cancer. In child cancer cases, anthracycline drugs such as doxorubicin are commonly associated with the treatment of such cancers as acute lymphoblastic leukemia (ALL). More than half of all child cancer patients receive treatment via anthracycline.

While often remarkably effective, anthracycline results in internal oxidation that can damage the tissue of the heart. However, the Dana-Farber study shows that patients given dexrazoxane in combination with doxorubicin maintained healthy heart function well beyond the time of treatment.

Just as important, dexrazoxane does not appear to reduce the effectiveness of anthracycline chemotherapy treatments.

These findings are based on a 15-year study led by Dr. Steven Lipshultz of the University of Miami Leonard M. Miller School of Medicine. From 1996 to 2000, he and his colleagues enlisted 205 child cancer patients to take part in the study. Over those four years, patients were split into two groups – one that received a high-dose of doxorubicin only and one that received an infusion of dexrazoxane prior to doxorubicin treatment.

For the next several years, the research team followed up with patients by monitoring their heart function with the help of echocardiograph equipment. Each patient’s heart health was compared to age-appropriate predicted measurements.

At the 5-year follow-up mark, children given dexrazoxane showed no statistically significant differences in heart function when compared to healthy peers. In contrast, patients who received doxorubicin alone were found to have significantly reduced heart function.

When looking at gender of patients, researchers report that females may enjoy greater benefits from dexrazoxane than males. This may be due to the fact that anthracycline has historically been more detrimental to female hearts than male hearts.

Previous studies have shown the short-term benefits of dexrazoxane in relation to heart health. Additional long-term follow-ups are required to further validate the efficacy and effectiveness of dexrazoxane over the long-term. Dr. Lipshultz also encourages researchers to initiate cooperative group trials that expand the study beyond the small scale.

Findings of the study were published in the September 16th online edition of Lancet Oncology. The research was funded in part by the National Cancer Institute’s Office of Cancer Survivorship.

ADAO to Host Seventh Annual Asbestos Awareness Conference April 1-3, 2011

The Asbestos Disease Awareness Organization (ADAO) has announced that it will conduct its Seventh Annual Asbestos Awareness Conference April 1-3, 2011 at the Atlanta Marriott Buckhead Hotel & Conference Center, in Atlanta Georgia. The conference will bring together researchers, scientists, physicians and educators from around the globe to discuss Asbestos: Impact on Public Health, Environment and Economy.

The conference is supported by the Barbara Ann Karmanos Cancer Institute of Detroit Michigan which is one of 40 National Cancer Institute-designated comprehensive cancer centers in the United States.  Attendees of the Conference are expected to hear about the “most advanced medical, occupational and environmental information to prevent home, school and work exposure,” according to ADAO’s press release.

ADAO was formed in 2004 by victims of asbestos and their families.  The goal of ADAO is to:

unite asbestos victims and give them and other concerned citizens a united voice to raise public awareness about the dangers of asbestos exposure;educate the public and medical community about asbestos-related diseases;support research that leads to early detection, prevention and a cure;and ban use of asbestos.

According to its website, ADAO will not be influenced by “outside sources such as drug companies, law firms, or companies that manufacture or use asbestos.”

According to the ADAO, more than 107,000 people are estimated to die this year from asbestos-related diseases, thus making their mission of educating the public about asbestos exposure and fighting for a universal ban relevant and urgent.

Diagnosed with Mesothelioma? Choose a Health Care Agent

Photo by US Living Will Registry
If you or a loved one has been diagnosed with mesothelioma choosing a health care agent, or what is also referred to as a “durable power of attorney for health care”, should be one of the first things on your list.   Mesothelioma is an incurable cancer that begins in the lining of the lungs, abdomen or heart due to prior exposure to asbestos, most of through one’s occupation.  Survival time from point of diagnosis is usually less than a year, so setting someone close to you to be your health care advocate is essential early on.
Designating a health care agent means giving someone you trust the power to speak for you regarding pain medication, types of treatments, life support, resuscitation, and end of life care when or if you become unable to communicate your wishes on your own.   It is best to have all this in writing and to let your physician, oncologist and medical team know who you have chosen to be your agent.
Your Health Care Agent will then be able to make all decisions for you regarding all aspects of your health care, including:
Power to direct, withdraw, or withhold life prolonging treatment, including artificial nutrition or hydrationPermission to allow, refuse or withdraw participation in federally regulated research related to mesotheliomaTake legal action, if needed Requesting, receiving or reviewing all information regarding physical or mental health, including medical and hospital records, and to sign releases to obtain such information on your behalf Make decisions about autopsy, tissue and organ donations, and disposition of body (in conformity to state law) after death
The health care agent only has authority to make care, custody and medical treatment decisions when the patient is no longer able to make them.    The agent then has power to make decisions according to your wishes that were expressed either verbally or written in what is often referred to as a living will.
Although having such conversations is not always easy, informing your health care agent of all desires concerning life-prolonging care, medical treatment and services, and after death procedures is necessary if you want to have choice around such matters, otherwise the health care facility will make them for you.
Having your wishes written and signed by witnesses ensures enforceability, as long as they are within legal and ethical bounds.  If you or a family member is diagnosed with mesothelioma, talking about such issues and making wishes specific and clear, is highly recommended.
If you have been selected to be a health care agent or durable power of attorney for your loved one, know their wishes ahead of time.  Ask questions so that you have a very clear understanding of what he or she wants.  Make sure that the treating physicians and nurses know who you are and how to contact you at all times.  Communicate the wishes to the medical team beforehand to make sure they can be followed without contest.
If you need help in having wishes enforced, ask to speak to the medical treatment facility social worker or patient representative.  Be polite, yet firm about making sure your loved one’s wishes are followed.  Take steps to take care of yourself as well as this is not always an easy role of responsibility to carry.
