New York Jury Awards Man $1 million

In the wrongful death case of Richard Schuderer $1 million was awarded to his estate. Richard Schuderer was diagnosed with mesotheliomain May of 2008 and died a little over a year later. He was exposed to asbestos, the mineral almost exclusively responsible for mesothelioma while working on tugboats. 

Schuderer had worked on the tugboats for 35 straight years. His job included oiling the tugboats on Lake Erie during the 50s which is where he was most likely exposed to the asbestos. The lawsuit alleged the gaskets were made by John Crane Inc., who received 60% of the liability, the rest went to other companies that had already settled.

Mesothelioma is a rare yet deadly and aggressive form of cancer that claims nearly 3,000 lives in the United States alone. Those diagnosed were most likely exposed to the prominent mineral, asbestos, used as a fire retardant and as insulation in many buildings. Mesotheliomais caused by the inhalation of this mineral, but there are no early symptoms and it can take over 30 years to diagnose. Most victims do not realize they have the disease until it is too late.  There is currently no cure for mesothelioma.

New Jersey Man Awarded $3 million

New Jersey resident, James Johnson, 75, who was diagnosed with mesothelioma has been awarded $3,333,500 in the case against the manufacturers of the asbestos-containing products that Johnson used and worked around. Johnson is a former carpenter, one of the many occupations that is at risk for contracting the asbestos-related disease.  Many carpenters are exposed to asbestos through working with ceiling tiles and acoustic ceilings that were manufactured in the 1970s and 80s when asbestos was prominent as an insulate and fire retardant. Due to widespread use of asbestos, many workers within the construction industry have been exposed to asbestos at some point during their employment.

Exposure to asbestos is almost the sole contributor to mesothelioma cancer and no immediate side effects arise after being exposed. The first signs can occur as much as 50 years after the initial exposure occurred. Johnson was reportedly in good health prior to his diagnosis.
