Mesothelioma Lawsuit Settlements

mesothelioma lawsuit settlements

Though the deadly effects of exposure to asbestos were documented years ago, it is still used in many commercial applications worldwide.  Companies have made great strides to keep workers safe from the effects of asbestos exposure; however, each year many people still become the victims of corporate negligence and develop asbestos-related diseases.

If you or a loved one has been diagnosed with mesothelioma, you may be considering a lawsuit.  Many Americans have received relief in the form of a legal award of compensation for damages or through a settlement with the manufacturer and/or employer.  The relief may cover medical expenses, lost wages, and other related costs.

Each year, large corporations make billions of dollars, sometimes by risking the lives of the ones who work so hard for them.  While most jobs have some kinds of risks, it is the employer’s duty to protect their employees and to let them know of potential risks.  When these ethical duties are not abided to, a lawsuit also holds the companies accountable for their actions and hopefully prevents others from acting in such a callous and reckless manner.

A mesothelioma lawsuit should be considered with great care.  Obviously, the defendant (the company being sued) will try to avoid paying any compensation, or by paying as little as possible.  A company that works with asbestos or has worked with it in the past may have already been sued many times, and may already have a team of lawyers and a suite of defense tactics ready and waiting.  They have experience and can use that experience gained over time to their advantage.

The most important aspect of initiating legal action is to locate an experienced mesothelioma attorney.  Normally, people choose a lawyer based on the advice of someone they trust. In the case of an asbestos-related lawsuit, however, you need to take the decision process somewhat further than that.  You need an attorney who know the ins and outs of this subject and has more knowledge and experience at this specific type of lawsuit than their opponent.

An experienced mesothelioma law firm will be able to help you through the complex legal process.  They usually don’t charge the client for their services for the lawsuit, but they do receive a percentage (usually between thirty and forty percent of the total amount awarded to the client) from the mesothelioma settlement.

During the case there will be many decisions to make, especially if the defendant offers a settlement.  Thankfully, a highly competent law firm with experience in asbestos-related cases can make this process much easier to go through.

Pleural Mesothelioma Treatment

pleural mesothelioma treatment

If you have or know someone with mesothelioma then you know it's an awful way to live your precious time on earth. The general lifespan of a person diagnosed with pleural mesothelioma or peritoneal mesothelioma is from 1 to 3 years. That figure varies from person to person depending on their age, general health and stage of the illness. Meaning a mesothelioma infected person may live even less than that.

This is all very sad and gloomy, but with traditional mesothelioma treatments life could be enhanced by eighty to a hundred percent. These meso treatments vary from surgery, radiation and chemotherapy. Regrettably these procedures don't cure the cancer; they just act on symptoms and try to alleviate the patient from as much pain as possible.

Radiation

Inside the traditional mesothelioma treatments, radiation is considered to be the best. Although secondary effects like skin irritation, hair loss and even nausea can accompany this treatment, your lifespan is expanded the most. This procedure tackles infected areas only so your whole body won't be bombarded by the rays.

Chemotherapy

It could be bitter at the start, but sweeter in the end. Causing nausea, hair loss, fatigue, general dehydration, between other side effects; it has been proven that infected cells die and are prevented from regenerating further more.

Surgery

This could be the most common of the mesothelioma treatments. No severe side effects come with this procedure. It's generally about going inside your body and removing tumors and affected zones with mesothelioma.

Future Mesothelioma Treatments

The National Cancer Institute of the United States is very much aware of this illness and is in the top 10 of their diseases to eradicate. They promote clinical campaigns that let the patient be part of and try to find new and more efficient and cost effective mesothelioma treatments. This is so because current treatments cost thousands of dollars and they should be available for everyone.

The Ultimate Guide to Mesothelioma - Learn How to Avoid Contracting Mesothelioma CancerMesothelioma is a form of cancer that is caused by exposure to asbestos. In this disease, malignant cells develop in the mesothelium, a protective lining that covers most of the body's internal organs. The most common sites for this disease are as follows: • Pleura – Outer lining of the lungs and internal chest wall• Peritoneum – The lining of the abdominal cavity, • Heart• Pericardium – The sac that surrounds the heart • Tunica Vaginalis – The membrane covering the testisPeople who develop Mesothelioma have worked in job locations where they inhaled asbestos particles or they have been exposed to asbestos dust and fiber. Research also suggests that people who are working in close association with those handling asbestos are also at risk of developing this disease. Unlike lung cancer, there is no association between Mesothelioma and smoking, but smoking greatly increases risk of other asbestos-induced cancer.

Japanese Find Effective Compound in the Search for the Cure for Mesothelioma

Japanese researchers at the National Institute of Advanced Industrial Science and Technology in Tokyo may have found a new compound to fight mesothelioma. The miracle compound? JBIR-23.

JBIR-23 is a natural compound that was first derived from the bacteria Streptomyces. In the test tube studies, its unique chemical structure had a cytotoxic effect on mesothelioma cells which led to cell death. Later when tested in mice with mesothelioma, the effect was the same.  JBIR-23 appeared to prevent the further growth of a tumor, without any other apparent side effects.

This is great news in the world of mesothelioma due to the fact that this particular lung cancer is considered an extremely aggressive cancer and is difficult to cure with conventional therapies.  It is also exciting because JBIR-23 not only prevents tumor growth but also leads to a reduction in the volume of tumors, a quality not found in other test subjects.

Mesothelioma is one of the most deadly and aggressive forms of cancer and claims nearly 3,000 lives in the United States alone. This form of cancer is caused by exposure to asbestos, a mineral used in construction, insulation and thousands of other products.  Early, accurate diagnosis is crucial to initiating treatment in time to slow the tumor’s growth.

Legal Options for Compensation for Mesothelioma

There are several ways to try to receive compensation if you have an asbestos related injury, such as mesothelioma, asbestosis or lung cancer.  If your injury occurred due to exposure to asbestos during the course of employment, one option is to pursue a workers compensation claim.  Workers compensation is a type of insurance held by employers to cover employees should they be injured on the job.

If you were injured during the course of military service, you may be able to pursue a veterans’ disability claim, although this process can be quite challenging as you must prove that your injury is directly caused by service exposure and there is no other form of possible substantial asbestos exposure prior to or post service work.

The third option is to file a third party injury case, also known as personal injury or wrongful death lawsuits, which sues the actual companies that made the products that caused the mesothelioma or asbestos related cancer.  These companies, and in some cases employers, knew about the health dangers caused by asbestos and yet were negligent to warn, train, prevent or protect workers from harm.

Most people diagnosed choose to pursue an asbestos or mesothelioma lawsuit because they are more likely to get fair and timely compensation.  Also, depending on the particulars of your case, many companies and manufacturers will settle outside of court, expediting the process and providing financial support when it’s most needed.

Because mesothelioma and asbestos related injuries do not develop until years after initial exposure, it can sometimes be difficult to know which companies and where the exposure which caused the injury occurred.  This is where it can be extremely helpful to find an attorney who is experienced and specializes in handling only asbestos lawsuits.  Such attorneys are experts in uncovering exposure history and identifying who is responsible.

If you file a third party injury lawsuit, your case is taken on what is called a contingency basis – meaning you don’t pay any fees unless you get a favorable verdict or settlement.  Therefore there is no financial risk to clients in pursuing a case.  However, each state has time limitations, called Statute of Limitations, for filing mesothelioma lawsuits, usually within one to two years.  To find out more about the statute of limitations for your particular state, visit the locations served page on the new site of Clapper Patti Schweizer & Mason.
